The Corruption of New York State Courts: Andrew Cuomo and Grand Larceny in Surrogates' Court

The media and many litigants in New York State are very aware that something has gone very wrong with procedural due process in the courts of New York State. In my case, Andrew Cuomo filed papers defending the Judges that stole my mom's property left to me in her Will. My lawyers, Eli Uncyk, Jeffrey Kofsky, and Jonathan Landsman, took my money for 12 years in order to help the judicial system harm me. I cant make this stuff up, but you dont have to believe me. Just read the documents and listen to the tapes. And I'm not the only person harmed by this group. Dont fall into their clutches. Betsy Combier

I am in federal court right now, fighting to get my mom's property that she left me in her Will that was stolen by the New York City Surrogate's Court, Jonathan Lippman, now chief presiding judge of the State, and the Attorney General - Eliot Spitzer and now Andrew Cuomo - and others, over the past 12 years.

I now many of you say oh yeah, sure, I'm another disgruntled person trying to get money for making well-known politicians look like thieves, and who the h___ am I to file a RICO against judges? Aren't they immune from prosecution?

Judges that act outside of their jurisdiction, as in my case, can and should be held accountable for their actions. Indeed, this happened in Pennsylvania and its happening everyday to someone in the United States.

When I went into heart failure July 22, 2006 after receiving an order from New York City Surrogate Court Judge Renee Roth telling me that she removed me as Executrix of my mother's estate and handed it over to the Public Administrator Ethel Griffin, my mind said "No way" but my heart started to stop.

Of course I didn't know that my heart was stopping, being a healthy person. I opened the certified envelope up in the lobby of my building after signing for the delivery, read Mr. Schram's letter, and went upstairs. I started feeling ill, and that a huge cement stone was on my chest. Taking a breath was difficult. I made some tea, but this didnt help. Then I called my doctor, as both my arms and legs felt like lead. He told me "get to the emergency room right now".

I admit that I am a little stubborn, and didnt take his demand as serious right away. But a few minutes later I saw the room spinning. Luckily, when I went to First Avenue with one of my daughters we got a taxi right away, and landed at Lenox Hill Hospital in about 4 minutes. They tried to find my pulse, and admitted me when they saw that my heart was beating 38 beats a minute, evidently not enough to pump blood to my brain.

Anyway, they kept me 3 days, and the day I was released, July 24, was the day that Judge Renee Roth made a new order in which she wrote that the Will was executed correctly, but Ethel Griffin was now the Administrator, in full control of the property of my mom. My mom's Will remains invalidated, despite the 1404 testimony of all the witnesses who attended the signing ceremony.

The injustice of all of this can be seen in my article above, and the writing I am currently doing to show the public how Attorneys Eli Uncyk, Jeffrey Kofsky, Jonathan Landsman, Kenneth Wasserman, Peter Schram, Ethel Griffin, Renee Roth, Mary Santamarina, Barbara Levitan, Eliot Spitzer, Monica Connell and Andrew Cuomo join together to steal property that does not belong to them.

The greatest thing of all is that by writing about all of them on websites and blogs I get to hear about other cases that involve many of these same people. I have heard from several people who have had the unfortunate circumstance to be victimized by any one or more of the following people:

During her tenure as Surrogate, Judge Roth issued 132 reported opinions, many addressing novel issues, including, e.g., the rights of children born through in vitro fertilization, the rights of non-marital fathers in adoption cases and the reformation of wills to maximize tax benefits for the estate. She was also responsible for developing and implementing the process for expediting the issuance of death certificates in the aftermath of the 9/11/01 attack on the World Trade Center. Before her election to the Surrogate's Court in 1982, Judge Roth served for 13 years as Law Assistant and Referee in the Kings County Surrogate’s Court.

Judge Roth graduated Phi Beta Kappa in 1961 from the City College of New York, and received her J.D. in 1969 from the Fordham University School of Law, where she currently serves as an Adjunct Professor teaching Estate Administration. She is Chair of the Surrogate's Court Advisory Committee of the Office of Court Administration, a Director of the Fordham Law School Alumni Association, and a member of the Executive Committee of the Surrogate's Association of the State of New York. She also serves as a Judicial Hearing Officer in the New York Supreme Court, Appellate Term. She is a frequent lecturer in New York State and around the country, and for many years authored the New York Law Journal column, "Wills, Estates and Surrogate's Practice."
