In DC May 13-19, thousands of ordinary people will transform themselves into local heroes and speak together for the first time. Those people courageous enough to speak out all have in common the terrible, life-changing retaliation that ends careers and lives, and tears families apart. 40 Public Interest Organizations Announce “Washington Whistleblower Week,”
Groups Urge Quick Senate Action on Whistleblower Rights Legislation (Washington, D.C.) – The Government Accountability Project (GAP) is joining 40 national public interest groups and hundreds of whistleblowers from across the country in sponsoring “Washington Whistleblower Week,” to be held May 14-18, 2007. The week’s events are designed to highlight contributions whistleblowers have made in society and to promote protections for whistleblowers who risk their careers to challenge abuses of the public trust. Supporting organizations view Washington Whistleblower Week as an opportunity to build on the momentum created by a historic vote in the U.S. House of Representatives, which on March 14 passed H.R. 985, the “Whistleblower Protection Enhancement Act of 2007.” The 331-94 vote is strong enough to override a potential White House veto, which was threatened on the day prior to the vote. “The House vote on H.R. 985 represents the most significant breakthrough for whistleblower rights in U.S. history,” stated GAP Legislative Representative Adam Miles. “With the exception of a few hold-outs in the White House, everyone agrees that government accountability is a good idea. These events will help show the Bush administration that the public demands these reforms and enthusiastically supports Congress’ efforts to enact stronger whistleblower protections.” “The House of Representatives whistled the truth,” added GAP Legal Director Tom Devine. “If the Senate follows suit, this reform will be the strongest government employee whistleblower law ever passed by Congress.” Federal Whistleblower Laws and Regulations Washington Whistleblower Week Starts Monday Event Highlights Need for Senate Passage of Bill WASHINGTON - MAY 10 - On Monday, May 14, the Government Accountability Project (GAP), 45 national public interest groups, and hundreds of whistleblowers from across the country will kick off Washington Whistleblower Week, running from May 14-18. The panels are designed to highlight congressional efforts to enhance whistleblower protections and other oversight initiatives. Please Note: In addition to Monday’s events, we would like to alert you to an Education and Labor Subcommittee on Workforce Protections Hearing on "Private Sector Whistleblowers: Are There Sufficient Legal Protections?" scheduled for Tuesday, May 15 at 2:00 p.m. in room 2175 Rayburn H.O.B. Tom Devine, GAP Legal Director, will be among the witnesses detailing a lack of protections for private sector whistleblowers. The No Fear Coalition of civil rights activists and whistleblowers is also sponsoring a symposium on Tuesday, May 15th, in Rayburn 2128, from 8:30 a.m. to noon. Last Congress, the Senate unanimously approved legislation that would overturn these hostile decisions and overhaul the broken WPA. This Congress, on March 14, 2007, the House passed H.R. 985, the Whistleblower Protection Enhancement Act of 2007. This panel will discuss the need for these reforms and the prospects of enacting them during this Congress. This is increasingly the case after September 11, with frequent breakdowns in communication threatening U.S. national and homeland security. This panel will consider the efforts made by Former Special Agents Rowley and German to break through the institutional walls at the Bureau, and the changes that are still necessary to confront bureaucratic threats to national security. This panel will consider the ways corporate, ideological, and political interests have undermined science, and the role of individuals of conscience in standing up for scientific integrity. The remarkable success of the Act is largely because of the unique public-private partnership established under the Act, which not only encourages whistleblowers to report misconduct, but actually empowers them to investigate and prosecute “fraudfeasors” on behalf of the federal government. States have also taken notice of this success and over thirty of them have either passed their own FCA or are currently considering similar legislation. This panel will highlight the success of state and federal FCAs and will provide a glimpse behind the public-private mechanism driving this success. Facilitator: Joseph E.B. The investigation is being initiated at the same time that a White House entity, called the President’s Council on Integrity and Efficiency, is completing its own investigation of Special Counsel Scott Bloch. This panel will consider the merits of both investigations and discuss what government employees should expect when they turn to OSC after being retaliated against for blowing the whistle. Whistleblower Internet Law Library Whistleblower Advocates Rally In Washington To Oppose Presidential Veto Threat WASHINGTON - April 30 - Over 50 public interest groups, and whistleblowers from across the United States, are planning the first-ever “Whistleblower Week in Washington (WWW),” scheduled for May 13-19, 2007 in Washington DC. Scheduled events will include press conferences on major whistleblower issues, seminars and panels attended by leading whistleblowers and Congressional-related events. Most events will be open to the press. Among the groups participating in WWW are the National Whistleblower Center, the No FEAR Institute (NFI), the Government Accountability Project (GAP), Doctors for Open Government, Semmelweis Society International, the National Security Whistleblower Coalition, the Veterans Affairs Whistleblower Coalition, the Liberty Coalition, "Project On Government Oversight (POGO)", The E-Accountability Foundation and the Make it Safe Coalition have committed to the event. Whistleblower Week was sparked by passage of The Whistleblower Protection Enhancement Act of 2007 in the U.S. House of Representatives and the issuance of a veto threat by President George Bush. “There is overwhelming grass roots support for strong whistleblower protections. Not even President Bush’s veto threat will slow down the momentum for this law. Once it is passed, we are certain he will sign it into law. The House has already passed the law with a veto-proof majority. Kohn, the President of the National Whistleblower Center. Whistleblower Week In Washington Seminars Offered Washington, D.C. - April 11, 2007. The National Whistleblower Center is sponsoring the following seminars during Whistleblower Week in Washington, May 14-18, 2007. There will be special seminars free of charge to whistleblowers and community supporters. The seating is extremely limited for these so register early. There will also be a full day Seminar for attorneys and whistleblower advocates, CLE credit will be available. The full day seminar is also on May 16 at the Willard InterContinental Hotel, it is not open to non-legal professionals and it is not free of charge. From the Editor: Below is one case of Whistleblower retaliation with the help of the Supreme Court. Supreme Court Again Undermines Whistleblower Rights: Rockwell International, Corp., et al. v. U.S. Washington, D.C. - March 27, 2007. The U.S. Supreme Court, in a 6-2 ruling, permitted a major federal contractor to escape liability for fraud against taxpayers. In the case, Rockwell International was found guilty of defrauding taxpayers of 1.3 million dollars. A whistleblower initiated a major federal investigation into Rockwell’s contracting fraud, fully cooperating with FBI and providing the predict information for a search warrant. The Supreme Court dismissed the significant contributions of the whistleblower and adopted Rockwell’s argument that a technicality concerning the disclosure justified dismissal of the claim. In response to the decision, the President of the National Whistleblower Center, Stephen M. Kohn, issued the following statement: Rockwell stole from the taxpayers when it failed to adhere to the terms of a binding federal contract. The Supreme Court ruling will result in whistleblowers being cheated out of rewards by unscrupulous contractors and well connected contractors. This is a disastrous ruling for the American public. By shutting the door on whistleblowers, the Supreme Court has cut the legs off of America’s most effective anti-fraud law. Rockwell International v.
