The E-Accountability Foundation announces the

'A for Accountability' Award

to those who are willing to whistleblow unjust, misleading, or false actions and claims of the politico-educational complex in order to bring about educational reform in favor of children of all races, intellectual ability and economic status. They ask questions that need to be asked, such as "where is the money?" and "Why does it have to be this way?" and they never give up. These people have withstood adversity and have held those who seem not to believe in honesty, integrity and compassion accountable for their actions. The winners of our "A" work to expose wrong-doing not for themselves, but for others - total strangers - for the "Greater Good"of the community and, by their actions, exemplify courage and self-less passion. They are parent advocates. We salute you.

TERMS OF USE & DISCLAIMER


1.General Terms of Use:

1-a. This page states the general terms of use under which you, the website visitor (hereinafter "you", "user", or "visitor") may use ParentAdvocates.org, By using this site, you agree to all of the Terms set forth below. Our purpose is to educate parents and assist them in finding out what the politico-educational complex is doing on a daily basis. You may reprint, copy, and use any article on this website as long as you do not sell or change the article and you cite parentadvocates.org as your source. Parentadvocates.org is an independent news source and is not affiliated in any way with The E-Accountability Foundation or any other group or entity.

1-b. Parentadvocates.org reserves the right, in its sole discretion, to change any or all of the provisions of this "Terms of Use & Disclaimer Agreement" at any time; the agreement in effect at the time of your use shall govern your use and your use after the effective date of any changes to these Terms will be deemed acceptance of your acceptance of the changes.

1-c. Parentadvocates.org reserves the right, in its sole discretion, to change, limit or discontinue any section or feature at any time. We reserve the right to remove, delete, or edit any material or information we deem, in our sole discretion, unacceptable, obscene, pornographic, or that violates the privacy of any person or entity who is not given public funds in return for services.

1-d. We reserve the right to keep any and all sources of information confidential in recognition of our official professional membership in the areas of journalism and news reporting.

1-e. Parentadvocates.org's goal is to give information to visitors on public school general and special education regulations; Federal, State and city laws, rules, and regulations; homeschooling options; advocacy guidelines; and resources to motivate, improve and challenge the learning and seeking of knowledge of children of all ages. We have posted websites, articles, commentaries and current news as part of this non-commercial effort to help children acquire tools for successful careers and life, whatever activities are chosen that benefits our society, and we have followed what we believe to be the guidelines of US Code TITLE 17, Chapter 1, Section 107: FAIR USE: "the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching, scholarship, or research, is not an infringement of copyright." We will, if asked with good reason to remove any material from our site that the original owner feels may jeopardize their standing before the Law, do so.

1-f. We oppose violence of any kind, disrespect, verbal or physical abuse, and any kind of theft or hurtful behavior toward anyone at any time, and expect all users of this website to be mindful of these values and use the information we have collected in good faith. We ask that you, the user, not send anything to us that infringes upon the intellectual property rights of others or on the privacy or publicity rights of private citizens; not send material that is or could be perceived as obscene, defamatory, threatening, harassing, abusive, hateful, or sexually explicit; not send any chain letters or pyramid schemes, or make false claims about anyone. We have made every effort to describe the actions, not motives, of public people, and we have supported everything that we post with documents to prove the validity of what we say in order to not make any fraudulent or false claims. We believe that it is a civic duty to expose wrong-doing, and we have the legal right to name the perpetrators who pursue illegal activities as defined by the respondents to their actions. If a public official or employee writes, says, or does anything that is against the Laws of this country or that falsifies data which leads to the intentional infliction of emotional distress, harassment, verbal and/or physical abuse of a student/parent/teacher, we claim license to post the acts of such people on our website, with the name of the perpetrator. We believe that this is accountability, and not slanderous or libelous in any way. The truth is not defamatory. We have dedicated our efforts to finding out what indeed the truth really is, and we have made a good faith effort to post only the actions/statements/letters that we have verified were sent by a member of the politico-educational complex THAT PROVE THE STATEMENTS MADE IN THE CONTENT OF THE STORY. We claim that we are not "out to get" any particular person and we are posting the information we have solely to stop the retaliation and fear of retribution that pervades New York City.

1-g. We believe that we are providing a service to the general public by holding elected and/or appointed officials accountable for their actions or silence, therefore we request that the content of the "Stories and Grievances" as well as "Current Opinion", "JUST ASKing", and "What Do You Think?" sections not be downloaded, reproduced or reprinted without the written consent of Parentadvocates.org (permission@parentadvocates.org) except for your own personal use clearly attached. You may, therefore, copy/distribute, and/or publish any opinion articles written by Betsy Combier as long as the article is not alterred in any way and the author's name is clearly listed.

You will not modify, publish, distribute, transmit, participate in the transfer or sale, translate, create derivative works, or in any way exploit other than set forth herein, any of the content, tools or technology, in whole or in part, found on Parentadvocates.org. Use of the site implies agreement that you shall not engage in any systemic downloading or other activity directed towards any of the content, in whole or in part, found on the site, that would create any electronic database or archive containing such content. You shall make no changes to any of the content that you are using under this agreement, and you will not delete or alter any proprietary rights or attribution notices in any content. You agree to not "frame" any of the content, tools, or technology on the site without written permission from Parentadvocates.org and Editor Betsy Combier (betsy.combier@gmail.com). You agree that you do not acquire any ownership rights in any downloaded content. You further agree that all rights in the Site and any of the content found on the site not granted to you under this agreement are expressly reserved to Parentadvocates.org. You agree to not extract any content in order to repurpose or resell the site's content or tools, and you agree to not "scrape" and/or reformat any information without the written permission of Parentadvocates.org.

1-h. Copyright in photographs, illustrations, artwork, graphic images and other non-text based materials contain within Parentadvocates.org may not be reproduced without the prior written consent of Parentadvocates.org or other copyright owners listed. Parentadvocates.org owns, protects and enforces copyrights for its' own creative material and respects the copyright property of others, as well as our right to "FAIR USE". We do not permit materials known by us to be infringing on the copyright of others to be on the site, and we ask that you notify us promptly if you believe that any materials infringe upon a third-party copyright. Upon receipt of a proper notice of claimed infringement under the Digital Millenium Copyright Act (DMCA), Parentadvocates.org's Editor Betsy Combier will respond promptly to remove or disable access to the material claimed to be infringing that is in our direct control, assuming that there is also infringement of FAIR USE.

1-i. We prohibit anyone from using the name Parentadvocates.org and text or non-text material contained on this website to express or imply endorsement, sponsorship, affiliation, or association of the user with or by Parentadvocates.org without written permission. We have a copyright of "A For Accountability" as well, and we have verified first use of this slogan.

1-j. This agreement and any policies and rules posted on Parentadvocates.org constitute the complete and exclusive and final expression of the agreement of the parties with respect to the subject matter hereof. No waiver by Parentadvocates.org or you of any breach or default under this agreement shall be deemed to be a waiver of any preceding or subsequent breach or default. This agreement shall be binding upon and inure to the benefit of and its' successors, trustees, and assigns. Parentadvocates.org may assign this agreement, or any of its rights or obligations under this agreement, with or without notice to you. Any such assignment by Parentadvocates.org does not relieve you of your obligations under this agreement.

2. Disclaimer

2-a. Parentadvocates.org provides as a service homepages of websites we believe may be helpful to the user; we provide these links and resources solely as a convenience to you, the user, and we do not endorse the content of these sites. Parentadvocates.org is not an Association, company, or legal entity, but solely a website/news source and as such makes no representations regarding the content or accuracy of materials on these sites. YOU AGREE THAT ANY RECOURSE FOR DISSATISFACTION OR PROBLEMS WITH THIRD-PARTY GOODS OR SERVICES WILL BE SOUGHT FROM THE THIRD-PARTY PROVIDER DIRECTLY.

3. Indemnification

3-a. To the maximum extent permitted by applicable law, you will defend, indemnify, and hold harmless Parentadvocates.org (and any of its parents, subsidiaries, affiliates, directors, officers, employees, agents, distributors, third party providers, and licensors from and against all claims, liability, and expenses, including attorney's fees and legal fees and costs, arising out of your use of the site or your breach of any provision of this agreement. Parentadvocates.org reserves the right, in its sole discretion and at its' own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. You will cooperate as fully as reasonably required in the defense of any claim.

4. Law Governing Performance and Disputes

4-a. This agreement, your performance under it, and any disputes arising under it shall be governed exclusively by the laws of the United States and the State of New York, without giving effect to their conflict of laws principles. You expressly consent to the exclusive forum, jurisdiction, and venue of the Courts of the State of New York and the United States District Court for the Second Circuit in any and all actions, disputes, or controversies relating to this agreement. You agree to pay all legal fees incurred by any legal action filed against Parentadvocates.org In which the website Parentadvocates.org Editor Betsy Combier as the Defendant prevails.

PRIVACY POLICY

Parentadvocates.org respects your privacy. Any information collected about your visit to the web site is non-personal in nature and used solely for the purpose of helping us to assess the areas of our site that are most useful to visitors, and therefore need to be as complete and user-friendly as possible. In the area of listserv sign-ups, contribution data, and/or any other email or membership sign-up option now or in the future on our site, all information is collected on a strictly voluntary and confidential basis, and will not be sold, used or released for any third-party purpose. We do not permit any transactions from or by any person who is 13 years old or younger.
